A Jefferson County woman has sued a driver and his employer, alleging negligence in a 2014 accident.
Catherine Rogers of Beaumont filed a lawsuit March 20 in Jefferson County District Court against Gary Enax and Digco Utility Construction damages incurred in an automobile accident.
According to the complaint, on Aug. 5, 2014, Rogers was operating her vehicle on Gulf Street heading toward Maple Street in Beaumont when Enax changed lanes suddenly and struck her car on the passenger side. The plaintiff sustained injuries to her neck, back, arms and general body even though she was wearing her seat belt, the suit states.
At the time of the accident, Enax was driving in his capacity as an employee of Digco, the suit states. The grievance cites Enax individually, alleging failure to maintain a proper lookout, yield the right of way, drive safely, and control his speed. Additionally, the suit cites Digco with gross negligence in hiring a reckless or incompetent driver; negligently entrusting the vehicle to Enax, and failing to properly train and supervise him.
Rodgers cites physical pain, suffering and disability, lost wages and earning potential, and medical expenses.
Rodgers seeks: more than $2.5 million in compensation; punitive and exemplary damages; attorney fees; expenses and costs. She is represented by attorneys McDonald “Don” Worley, Jeff Musslewhite and Lori Brown of McDonald Worley in Houston.
