The automobile personal injury trial of Albert Lee and Louella Thomas vs. Victoria Belle Outlaw is slated to start Tuesday, Aug. 14, in Judge Milton Shuffield's 136th District Court.
According to the plaintiffs' original petition, filed Dec. 28, 2005, in the Jefferson County District Court, the Hardin County couple was traveling westbound on Calder Avenue when Outlaw made a left turn out of a private drive and struck their vehicle.
The incident occurred on Feb. 4, 2004, and the plaintiffs believe the collision and their injuries were caused by the negligence of Outlaw, who they claim "failed to yield the right-of-way to oncoming traffic," the suit said.
The plaintiffs are suing for past and future physical pain, mental anguish and medical expenses.
Albert Lee is also suing for market price of his vehicle, which according to his suit is $4,000, actual damages for towing and storage of the vehicle and the loss of use of his vehicle.
"Because of the incident�plaintiff has been forced to rent a vehicle on numerous occasions," the suit said.
The plaintiffs are represented by Thomas Moses, Attorney at Law.
