Johnella Chambers says she was "attempting to be a customer" at the Walgreens on Lucas, but she slipped and fell, twice, after walking across a wet mat before she could start shopping.
She filed her personal injury lawsuit with the Jefferson County Court at Law No. 1 on Aug. 16. Judge Alfred Gerson will preside over the case.
According to the plaintiff's original petition, on April 25, 2007, Chambers braved the rain and entered the Walgreens, "but there was so much water on the floor that after a person would pass the mats and get onto the tile floor they could not keep their balance."
The suit goes on to say Chambers assumed the store's floor would be safe after walking across the wet mat, but the tile turned out to be "extremely slick with water."
After she fell, Chambers rose to her feet only to slip again, the suit said, adding that there were no hazard signs posted near the store entrance.
In her suit, Chambers' claims she left the store to alert her mother to her plight. She returned to the Walgreens to inform the manager that she had been injured and, now found wet-floor signs stationed around the area where she had fallen.
"(Then Chambers) walked out to her car to see her mother who had driven her to the store and then came back into the store to tell the manager she had been injured and there were then wet floor signs out around the area where she had fallen," the suit said.
The suit faults Walgreens with negligently failing to post wet-floor signs, provide adequate matting, failing to properly mop the area and warn costumers of the dangerous condition.
Chambers is suing for past and future medical expenses, physical pain and mental anguish.
She is represented by attorney Woodson Dryden.
