Kyle Perry claims he was hit in the face by a burst of acid while demolishing some plant lines.
He and his wife, Sherri, are suing Allied Machine Works Inc. and two of its supervisors, Bobby and John Travis, for failing to provide a safe place to work.
The couple filed their personal injury lawsuit with the Orange County District Court on Aug. 17.
According to the plaintiff's original petition, on April 18, 2007, Perry, an Allied employee, was doing a demolition job for the MeadWestaco Corp. Perry and his co-workers began to demolish the plant line when acid suddenly erupted from it, striking Perry in the face.
In his suit, Perry claims the defendants were negligent for failing to purge the line, which demonstrated a "conscious indifference" to his "rights and welfare."
"This was manifest in the failure of defendants to inspect the lines for acid before assigning Perry to remove the lines, all while representing to Perry that the work area was free of unreasonable danger and free of toxic, acutely hazardous chemicals," the suit said.
Perry is suing for past and future medical expenses, physical pain, disfigurement and mental anguish. His wife is suing for loss consortium.
The couple is represented by attorney Joseph Blanks.
The case has been assigned to the 128th Judicial District.
