FELA suit alleges negligence by KCS

Kansas City Southern Railway Co. employee James Walter Murray has filed a Federal Employers Liability Act suit against the railroad claiming he suffered a foot injury due to the company's alleged negligence.

Murray's suit, filed in the Jefferson County District Court on March 10, does not state how he was injured, where he was injured or how KCS' negligence contributed to his foot injury.

The suit only states that on March 4, Murray was injured "due to the negligence of KCS."

The suit continues by asserting KCS failed to provide Murray with a safe workplace and that his injuries are permanent in nature.

According to the KCS Web site, the company focuses on employee safety first. "We recognize that safety is our first priority. Every employee is responsible for their own safety and the safety of others and is empowered to take the actions necessary to accomplish this goal."

Murray is suing for past and future mental anguish, lost earnings, impairment, disfigurement and medical expenses.

He is demanding a trial by jury and is represented by senior Provost Umphrey partner David Wilson.

Judge Gary Sanderson, 60th Judicial District, has been assigned to the case.
