A delivery man alleges he was ambushed by falling trusses when a forklift driver carelessly pushed them off a trailer.
William M. Morgan filed suit against Sli Framing Co. and Greystar Development and Construction on May 14.
According to Morgan's petition, on March 13, 2007, he was making a delivery to a job site maintained by Greystar and was seriously injured when a Sli Framing forklift driver "pushed trusses off a trailer onto his body."
"The incident in question was proximately caused by the carelessness and negligence of Defendants," the suit says.
"Plaintiff would show that as a result of the negligence of Defendants, he sustained serious injuries and has sustained much physical pain and mental anguish in the past, and will in all reasonable probability, continue to suffer the same in the future."
Morgan is also suing for past and future impairment, disfigurement, loss of earning capacity and medical expenses.
He is represented by the Law Offices of Bennie D. Rush.
Judge Milton Shuffield, 136th Judicial District, has been assigned to the case.
