A Beaumont man has filed suit against Charles E. Gibbs and his insurance agency for "barraging him with racial epithets," court papers say.
Clifford J. Miles' defamation suit, claiming emotional distress, was filed July 14 in Jefferson County District Court.
"This is a lawsuit for slander ... and intentional infliction of emotional distress," Miles' lawsuit says. "Namely, the Gibbs Agency treated Miles in an egregious manner, barraging him with racial epithets both to him individually, and also in the presence of others."
The lawsuit does not specify whether Miles was an employee or a client of Gibbs.
In court papers, Miles alleges Gibbs behavior has impugned his work ability in the presence of others.
"Additionally ... the defendants have sought to evict plaintiff from his residence for no reason other than motivated by defendants' racial animus toward plaintiff," the suit says.
Miles is seeking to recover actual damages including lost wages, expenses incurred as a proximate result of the defendants' alleged tortious conduct and also mental anguish damages.
He is demanding a trial by jury and is represented by attorney John Morgan of the Lindsay & Morgan law firm.
The case has been assigned to Judge Gary Sanderson of the 60th Judicial District.
