This Just In: Recent civil suits filed in Orange County District Courts

July 3

  • Gary and Elsa Jones vs. Nina Holland

    PA – Hart Green, J – Dennis Powell

    The plaintiffs were traveling in the left lane on North Lutcher in Orange when the defendant, who was traveling in the right lane, swerved into the plaintiffs' lane and struck their vehicle. The lawsuit does not say when the collision occurred.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and are suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Jules Daniel vs. Wal-Mart

    PA – Thomas Moses, J – Pat Clark

    Last year, Jules Daniel went to the Orange Wal-Mart to pick up some groceries and have the oil changed in his pickup. Shortly after he left the store, the truck froze up and the engine died. Daniel claims the Wal-Mart employee stripped the threads on the oil change plug.

    He is seeking actual and consequential damages.

  • Bo Jack Davidson et al vs. American Home RTO

    PA – Clay Dugas, J – Dennis Powell

    An Orange County couple is suing American Home RTO, claiming one of the company's employees entered their home and assaulted their minor children.

    The plaintiffs are suing for exemplary damages.

    The plaintiff is suing the defendant for $27,624 in unpaid invoices for services performed beginning in the year 2007.

  • April Chandarlis et al vs. Lindsay Jo Pantely

    PA – Jeffrey Chilton, J – Dennis Powell

    The plaintiff is suing individually and on behalf of her two minor children for an automobile collision allegedly caused by the defendant on Aug. 8, 2006. The suit says the incident occurred in the city of Orange but does not give specifics on how the incident occurred.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and are suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Sherry Hearne vs. A.O. Smith Corp.

    PA – Bryan Blevins, J – Pat Clark

    Seeking monetary compensation for her benefactor's asbestos-related death, Sherry Hearne is suing the A.O. Smith Corp. and 42 other companies for exemplary damages.

    The suit does not give any specifics on Adam's history and death.

  • Randy Kirkwood vs. Waste Management of Texas Inc.

    A garbage man who hurt his himself while manually picking up trash cans has filed suit against Waste Management of Texas, claiming the company failed to "warn him of the dangerous condition."

    The plaintiff is suing for past and future mental anguish, medical expenses and lost wages.

  • Triple L Sales & Equipment vs. C&C Demolition

    PA – David Dies, J – Dennis Powell

    The plaintiff claims the defendant rented a forklift from its business July 11, 2006, and returned it in a damaged condition. The plaintiff is suing for $27,734.84 in actual damages, plus all court costs.

  • Mary Bethay vs. Tuffy's Eatery

    PA - George Barron, J – Buddy Hahn

    A Mississippi resident is suing a Mauriceville restaurant, claiming the diner negligent failed to warn patrons that its floors were uneven.

    Bethay claims Tuffy's Eatery's deliberate negligence entitles her to exemplary damages. She is also suing for past and future mental anguish, medical expenses and impairment.

  • Troy McLehany vs. At&T

    Upset that a competitor's ad is above his, Troy McLehany has filed suit against AT&T, alleging the company's choice in ad location has "overshadowed" his company, supposedly costing him potential customers.

    McLehany is suing for exemplary, actual and economic damages, plus attorneys' fees.

  • David Delassus et al vs. Todd Castle

    PA – Clay Dugas, J – Pat Clark

    Delasuss, individually and on behalf of his minor children is suing Castle, who allegedly was driving drunk and caused an automobile collision Dec. 16, 2007. The incident occurred on SH 12 in Mauriceville.

    The plaintiffs allege the defendant negligently failed to keep a proper lookout and are suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.
