Orange couple says rental company employee assaulted children

Clay Dugas

An Orange County couple is suing American Home RTO, claiming one of the company's employees entered their home and assaulted their minor children.

On behalf of their minor children, Bo Jack and Rachel Davidson filed suit against American Home on July 8 in Orange County District Court.

According to the Davidsons' lawsuit, on Aug. 17, 2007, rent-to-own company American Home sent an employee to their Orange home.

"Defendant's employee entered plaintiffs' home and assaulted the minor children and intentionally inflicted emotional distress on the children by threat of injury," the suit says. "Defendant was negligent in the hiring, training and supervision of its employee."

The suit fails to state if the Davidsons were present during the alleged assault and why the employee was sent to their home and allowed to enter.

The plaintiffs are suing for exemplary damages, plus past and future mental anguish and medical expenses.

They are requesting a trial by jury and are represented by attorney Clay Dugas.

The case has been assigned to Judge Dennis Powell, 163rd Judicial District.

Case No. B-080254-c
