Mississippi woman trips, sues Tuffy's

ORANGE -- A Mississippi woman is suing a popular Mauriceville restaurant, claiming the diner negligently failed to warn patrons that its floors were uneven.

Mary Bethay filed her lawsuit against Tuffy's Eatery on July 11 in Orange County District Court.

On July 21, 2006, while at Tuffy's, Bethay was walking when she fell "as a result of an uneven floor without any sign or warning," court papers say.

In her lawsuit, Bethay goes on to allege the floor's condition posed an unreasonable risk of harm and that the restaurant had a duty to warn her of the floor's dangerously uneven condition.

Bethay claims Tuffy's Eatery's deliberate negligence entitles her to exemplary damages.

She is also seeking damages for past and future mental anguish, medical expenses and impairment.

The plaintiff is represented by attorney George Barron of Orange.

The case has been assigned to Judge Buddy Hahn, 260th Judicial District.
