This Just In: Recent civil suits filed in Jefferson County District Courts

Sept. 26

  • Frank and Pamela Rose vs. Farmers insurance Exchange et al

    PA – Rocky Lawdermilk, J – Milton Shuffield

    The plaintiffs are suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of their Hurricane Humberto damage claim.

    The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations. The plaintiffs are suing for actual and consequential damages, plus attorneys' fees.

  • Blonnie and Glenda Dent vs. Capitol County Mutual Fire Insurance Co. et al

    PA – Steve Mostyn, J – Milton Shuffield

    The plaintiffs are suing the insurance company and several of its claims adjusters for allegedly refusing to pay at least a portion of their Hurricane Rita damage claim. The suit alleges the defendants are guilty of Texas Insurance Code and DTPA violations.

    The plaintiffs are suing for actual and consequential damages, plus attorneys' fees.

  • Anthony Alderete vs. The Goodyear Tire & Rubber Co. et al

    PA – Robert Ammons, J – Gary Sanderson

    The plaintiff is suing Goodyear claiming he was injured in the June 11 explosion that happened at the defendant's Houston plant. The plaintiff is also suing Texas Petrochemicals, a company located adjacently to Goodyear, claiming the company did not do enough to shield him from the explosion.

    The plaintiff is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Luther Defee vs. A.O. Smith Corp. et al

    PA – Bryan Blevins, J- Bob Wortham

    The plaintiff is suing on behalf of her late husband, Willie Defee, claiming he died of an asbestos-related illness. The plaintiff's suit faults 37 defendants, alleging the corporations conspired to mine, process, sell and use asbestos products – despite having actual knowledge that the products were hazardous.

    The plaintiff is suing for punitive damages, plus her husband's past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Ken and Esther Scarborough vs. United Medical Clinic et al

    PA – Key Van Wey, J – Gary Sanderson

    The parents of Christopher Scarborough are suing UMC, several of its physicians and Lifechek Conroe, claiming the defendants are responsible for their son's death, who died of a prescription drug overdose.

    On Sept. 18, 2007, Christopher drove Lifechek to have his prescriptions filled after a medical checkup at UMC. The suit says he died a few days later by a cause of drug toxicity and pulmonary edema.

    The suit claims the prescriptions were excessive.

    The plaintiffs are suing for wrongful death damages.

  • Transit Mix Concrete & Materials Co. vs. Civco Management Group and Paha Legacy

    PA – Bill Richey, J – Donald Floyd

    The plaintiff is suing the defendants in hopes of collecting on a pass due account. The plaintiff claims it is owed $85,940.31.

  • Magdalene Mitchell vs. Annette Barrows

    PA - Clay Dugas, J – Milton Shuffield

    On Nov. 18, 2006, the plaintiff was traveling through the St. Elizabeth Hospital parking garage when she was rear-ended by the defendant.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Graig Odom vs. Total Petrochemical

    PA – Adam Terrell, J – Bob Wortham

    The plaintiff, a Total contracted employee, claims he suffered an injury Sept. 30, 2006, while on defendant's premises. The suit does not describe how the plaintiff was injured and only says the defendant was negligent for failing to provide him with a safe workplace.

    The plaintiff is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Keith Romero vs. Devall Towing & Boat Service

    PA – Kurt Arnold, J – Donald Floyd

    The plaintiff has filed a Jones Act suit against the defendant for an injury he received more than two years ago, April 24, 2006. The defendant was injured when the captain "threw the boat in reverse," the suit says.

    The plaintiff is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Henry Roy vs. Eastex Automotive

    PA – John Morgan, J – Milton Shuffield

    On April 3 the plaintiff brought his vehicle into the defendant's shop for repairs and never got it back. The plaintiff had to go through the BBB to get his car back. When it was returned, the vehicle was missing parts, the suit says.

    The plaintiff claims the defendant violated the DTPA and is suing for actual and treble damages.

    On April 14, 2008, the plaintiff was slowing due to traffic congestion when she was rear-ended by the defendant.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • Janet Drago et al vs. Stacey Cason

    PA – Janet Drago, J – Bob Wortham

    The plaintiff has filed a pro se suit individually and on behalf of her minor grandson for an automobile collision that occurred Oct. 1, 2006. The plaintiff was driving in the Parkdale Mall parking lot when the defendant cut across the lot and struck her vehicle.

    The plaintiff alleges the defendant negligently failed to keep a proper lookout and is suing for past and future medical expenses, mental anguish and impairment, plus actual damages and attorneys' fees.

  • John Cezar vs. Jefferson County Texas

    PA – Michael Kerensky, J – Milton Shuffield

    The plaintiff, a county employee and black male, claims he was discriminated against when the county chose to hire a white man over him. The plaintiff had been working as a gardener for the county for about four months when he applied for a maintenance job.

    The plaintiff is suing for past and future lost wages and mental anguish.
