Worker claims construction company did not live up to employment contract

A Louisiana man has filed a breach of contract complaint against One Stop Construction and Restoration, alleging it did not give him a three-year notice as outlined in a contract before it terminated him.

Temple Willett and One Stop Construction and Restoration entered into a written employment agreement on Jan. 23 which said Willet was to be employed as a superintendant and was to make $800 per week, plus a weekly vehicle allowance of $125, according to the complaint filed Nov. 21 in Jefferson County District Court.

Under the terms of the agreement, Willett was to be paid the wages for the entire employment term, and if either he or One Stop Construction and Restoration wished to terminate the agreement, they would be required to submit a three-year notice, the suit states.

Willett claims he fulfilled his obligations of overseeing crews, handling financial matters, ordering materials and supplies and performing construction-type work on homes, but was fired on June 26 for no reason.

When he was fired, he was not given the required three-year notice and has not been compensated since his firing, according to the complaint.

"Therefore, Defendant is also obligated to pay Plaintiff such compensation due and owing under the Agreement as well as interest of 18 percent APR on such amounts, as stipulated in the Agreement," the suit states.

Willett is seeking a monetary judgment pursuant to his breach of contract claim, an award for lost wages and the contractually agreed upon interest, plus prejudgment interest at the maximum legal rate, post-judgment interest at the legal rate, court costs, attorneys' fees and other relief to which he is entitled.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
