This Just In: Recent civil suits filed in Orange County District Courts

  • Melvin Franklin vs. Tin Temple Inland Inc.

    PA - Don R. Caggins, Sr., J - Dennis Powell

    Hit on the head by a 30-pound piece of saltcake while working on Tin Temple Inland's premises nearly two years ago, Melvin Franklin is now alleging the company failed to provide him with a safe workplace and has filed suit.

    On top of exemplary damages, Franklin is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Earl Kaspar vs. Absolute Construction LLC

    PA - Clay Dugas, J - Dennis Powell

    After Hurricane Rita ravaged his home, the plaintiff hired the defendant to repair his roof. Last July, the plaintiff began to notice black mold growing in his home and discovered it was the result of a leaky roof.

    The plaintiff claims the defendant has breached its contract by refusing to properly repair his home and is suing for actual and consequential damages.

  • Michael Reifsnider vs. W.W. Webber et al

    PA - Jeff Seely, J - Pat Clark

    Two years after driving his car off Interstate 10 and into a pile of dirt and debris, Michael Reifsnider has filed suit against the company was performing construction on the interstate and the makers of his vehicle.

    The incident left Reifsnider paralyzed from the waist down.

    On top of exemplary and actual damages, the plaintiff is suing for past and future mental anguish, lost wages, medical expenses and impairment.

  • Ricky Childress vs. Foremost Lloyds's of Texas et al

    PA - Gilbert Adams Jr. J - Buddy Hahn

    The plaintiff is suing his insurance company and one of its agents for allegedly refusing to pay at least a portion of his Hurricane Humberto claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    He is seeking actual and consequential damages.

  • City of Orange vs. Ruth Cox

    PA - Margaret Reaves, J - Pat Clark

    The city of Orange is suing Cox for striking and injuring one of its police officers with her car on June 26, 2007.

    The officer had pulled over a vehicle on Park Street and was in the process of talking to the vehicle's owner when Ruth struck him.

    The suit says Ruth was not even aware she had hit him until she was flagged down by a motorist.

    The city is suing to recover around $55,500 in benefits paid to the officer.

  • Leory Breedlove vs. Texas Fair Plan Association

    PA - Rocky Lawdermilk, J - Dennis Powell

    The plaintiff is suing TFPA for allegedly refusing to pay at least a portion of his Hurricane Rita claim.

    The plaintiff claims the defendants breached their contract and are guilty of several insurance code violations.

    He is seeking actual and consequential damages.
