Stag Parkway has filed a breach of contract complaint against Windrider RV and Trailer and Steven L. Lackey, alleging they failed to pay a balance due for goods and services delivered to them.
Represented by Michael S. Goodrich and Raymond B. Albertson of Goodrish, Postnikoff, Albertson and Petrocchi in Fort Worth, Stag claims Windrider promised to pay Stag for goods it provided but has failed and refused to pay the balance.
"Defendant Windrider received the goods, wares, merchandise and/or services set out in the account attached hereto and accepted the benefits thereof and Plaintiff is entitled to recover the reasonable value of the benefits conferred, all of which Plaintiff alleges to be the sum of at least $42,981.07," the suit filed Dec. 11 states.
Lackey executed a personal guaranty on April 4, 2006, guaranteeing to pay Stag amounts due by Windrider, but has refused to make payments, Stag claims.
In addition to the balance due, Stag is seeking pre- and post-judgment interest, reasonable attorneys' fees, costs and other relief to which it may be entitled.
The case has been assigned to Judge Bob Wortham of the 58th District Court.
