R.L. Eldridge Construction has filed a breach of contract complaint against R&R Marine Maintenance, alleging it failed to pay for goods and services delivered to it.
Represented by Gary Linthicum of Wells, Peyton, Greenberg and Hunt in Beaumont, R.L. Eldridge Construction of Sabine Pass claims R&R Marine Maintenance, also of Sabine Pass, became obligated to pay it for goods and services it provided from December 2007 through September 2008.
However, R&R Marine Maintenance has failed and refused to make payments due, according to the complaint filed Dec. 10 in Jefferson County District Court.
"After all lawful, due, and proper offsets, payments, and credits have been allowed, that remains due and owing to Plaintiff the sum of $478,224.45," the suit states.
In addition to the balance due, R.L. Eldridge is seeking pre- and post-judgment interest and the highest rate allowed by law, costs, attorney's fees and other relief to which it may be entitled.
The case has been assigned to Judge Milton Shuffield of the 136th District Court.
