Plaintiffs sue driver who caused rear-end pile up

Two Silsbee residents claim they sustained injuries to their necks and backs after a driver struck the vehicle behind them, forcing that vehicle to rear-end them.

Judye Golden and Craig Martin filed a lawsuit April 23 in Jefferson County District Court against Justin Deyoung and Nexstar Broadcasting Group.

According to the complaint, on Nov. 4, 2008, Martin was driving north on Eastex Freeway over the Delaware overpass with Golden as a passenger.

Martin sat still waiting for stopped traffic to advance when Brett Tremblay, who also sat in stopped traffic behind Martin, suddenly rear-ended. The suit states Deyoung failed to control his speed and struck Tremblay, pushing Tremblay into Martin.

At the time of the collision, Deyoung worked for Nexstar Broadcasting Group, the suit states.

In addition to her back and neck injuries, Golden claims she now suffers from severe headaches, and both plaintiffs claim they incurred medical costs and experienced physical pain, suffering and mental anguish because of the collision.

They blame Deyoung for causing the accident, alleging he negligently failed to keep a proper lookout, failed to avoid a collision, failed to maintain control of the vehicle, failed to control his speed and failed to drive as a reasonable person would have.

The plaintiffs seek a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest, actual damages and other relief the court deems just.

The case has been assigned to Judge Bob Wortham, 58th District Court.
