SHERMAN-State Farm is suing Whirlpool to regain more than $100,000 in insurance benefits that it paid to its insured after part of an ice maker caught on fire.
State Farm Lloyds, as subrogee of Corene Adock, filed suit against Whirlpool Corp. and Springfield Wire on June 11 in the Denton County District Court. The defendants removed the case to the Eastern District of Texas, Sherman division on July 21.
The fire occurred on June 15, 2008 at the home of Corene Adock, when an electrical failure in the ice maker's heating element ignited the surrounding combustible components.
Causes of action filed against the defendants include strict liability, negligence and breach of warranty.
The plaintiff is seeking a reimbursement in the total amount of $117,484.18, plus interest.
The plaintiff is represented by Plano attorneys N. Scott Carpenter, Craig M. Schumacher, Brian R. Wesley and L. Mark McMillion of Carpenter and Schumacher.
U.S. District Judge Michael H. Schneider is assigned to the case.
