A townhouse owners' association claims it can't repair Hurricane Ike damage because of its insurance company's misleading actions.
Briar Creek Townhomes filed a lawsuit Aug. 20 in Jefferson County District Court against Braud, Vaughn and Williamson Insurance Agency.
Briar Creek claims it renewed building coverage with the agency in 2008 and believed the renewal policy would have the same coverage as the original.
Hurricane Ike struck on Sept. 13, 2008, and Briar Creek filed a claim for its damages.
It was then it learned the renewal policy was different from the original, the suit says.
Briar Creek had to take out a Small Business Administration loan to pay for the repairs, the lawsuit claims.
The plaintiff alleges fraudulent misrepresentation, negligent misrepresentation and non-compliance with the Texas Deceptive Trade Practices Act.
Briar Creek seeks actual and punitive damages and attorney's fees.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
