Two Hardin County residents have filed suit against a driver after they say she failed to yield the right-of-way and collided with the vehicle in which they were riding.
Mark and Carrie Gaspard claim they were riding in a vehicle traveling in Jefferson County on Sept. 23 when defendant Sue Parsley struck their vehicle.
Because of the accident, the Gaspards experienced physical pain and suffering; incurred medical costs and sustained physical impairment and physical disfigurement, according to the complaint filed Oct. 26 in Jefferson County District Court. In addition, the plaintiffs endured emotional distress and lost their ability to enjoy life, the suit states.
Parsley negligently failed to keep a proper lookout, drove too fast, failed to yield the right-of-way, lacked proper control and failed to timely apply her brakes, the complaint says.
In their complaint, the Gaspards are seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief to which they may be entitled.
John Werner of Reaud, Morgan and Quinn in Beaumont will be representing them.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
