Tow truck driver claims man ran over him

Tow truck driver Darrell Richmond claims he was run over when John Elliott released the brakes on his car while he was underneath it trying to secure a connection.

Richmond filed suit against Elliot and his former employer, Specialized Transportation, on Jan. 19 in Jefferson County District Court.

According to the petition, on Jan. 19, 2009, Richmond was attempting to tow Elliot's vehicle. While under the car attempting to secure a tow connection, "Elliott negligently released the brakes."

"The vehicle ran over plaintiff as a result," the suit states, adding that Elliot's negligent and careless actions caused him severe injury.

The suit further claims Specialized Transportation is vicariously responsible for Elliot's actions, but does not state how.

Richmond is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

Judge Milton Shuffield, 136th District Court, has been assigned to the case.
