Tractor-trailer runs into back of vehicle, driver sues

MARSHALL - After a tractor-trailer ran into her vehicle, Dorris Baker filed suit against Algie Marcus Whitaker Jr. individually, and doing business as Whitaker Moving and Express.

The lawsuit was filed on March 31 in the Eastern District of Texas, Marshall Division.

According to court documents, Whitaker was driving a tractor-trailer on Interstate 20 in Gregg County on Nov. 8, 2010, when he failed to control his speed and drove into the back of Baker's vehicle.

Baker accuses the defendant of negligence for failing to maintain an assured clear distance behind her vehicle and failing to maintain his attention.

Baker states the accident caused her to suffer serious injuries to her back, shoulder and body.

The plaintiff is seeking damages for physical pain and mental anguish, medical expenses, physical impairment, loss of earnings, loss of earning capacity and interest.

Baker is represented by Tyler attorney Keith Miller and Blake C. Erskine of Erskine & McMahon in Longview. Jury trial is requested.

U.S. District Judge T. John Ward is assigned to the case.
