Suit alleges side step fell and struck rig worker's head

Jorge Garza has filed suit against E.A. Collins & Sons, alleging an improperly welded side step broke loose and struck him in the head.

The suit was filed May 27 in Jefferson County District Court.

According to the lawsuit, on July 2, 2010, Garza worked as a rig hand on a rig in the Beaumont area. The platform he worked on consisted of several pieces, including metal side steps one of which broke loose and struck him on the head.

"Defendant attached the side step that fell to the rig derrick by welding it with hinges," the suit states. "A failure of a weld made by E.A. Collins & Sons caused the step to fall and strike Garza."

The suit faults the defendant with negligence.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Corpus Christi attorney William Edwards III represents the plaintiff.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
