Woman sues BISD after wreck with driver

A Harris County woman claims she and her minor daughter suffered from physical pain after a driver for the Beaumont Independent School District struck their vehicle.

Christina Leday filed a lawsuit June 21 in Jefferson County District Court against the school district and its driver, Michael Wayne Pete.

In her complaint, Christina Leday claims she and her minor daughter, Raven Leday, were traveling in Jefferson County on Jan. 19 when Pete collided with them.

In addition to their pain, Christina and Raven Leday incurred medical costs, experienced mental anguish, lost earnings and earning capacities and sustained physical impairment because of the collision, according to the complaint. Christina Leday also suffered property damages to her vehicle, the suit states.

Christina Leday blames Pete for causing the collision, saying he negligently failed to keep a proper lookout, failed to maintain control of his vehicle, drove too fast, failed to apply his brakes, failed to exercise ordinary care and failed to turn his vehicle to avoid the collision. In addition, Pete negligently failed to keep a proper distance from Christina Leday's vehicle, failed to drive within a single lane, failed to change lanes only when it was safe to do so and drove too fast, the complaint says.

Christina Leday also names Beaumont Independent School District as a defendant, saying it negligently entrusted its vehicle to Pete, who Christina Leday describes as a reckless and incompetent driver.

In her complaint, Christina Leday seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief to which she may be entitled.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing her.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
