A Beaumont partnership alleges it lost out on rental payments when one of its tenants violated a lease agreement.
Davis Colonnade filed a lawsuit June 24 in Jefferson County District Court against Kacy West, doing business as High Maintenance.
In its complaint, Davis Colonnade claims it entered into a lease agreement with West for retail space located at 6354 Phelan Blvd. in Beaumont on Feb. 24. The lease began on March 31, 2010, and was supposed to continue for three years, according to the complaint.
However, West ceased making rental payments in July 2010, the suit states. In addition, West abandoned the premises, violating the lease agreement, the complaint says.
"Plaintiff sought to minimize its damages by reletting the property but did not locate a replacement tenant until October, 2010," the suit states.
In its complaint, Davis Colonnade seeks a judgment for the total amount due under the lease, plus pre-judgment interest, attorney's fees, costs, post-judgment interest at the highest legal rate and other relief the court deems just.
John Creighton, Brian Mills and J. Cullen Mouton of Creighton, Fox, Johnson and Mills in Beaumont will be representing it.
Judge Gary Sanderson, 60th District Court, has been assigned to the case.
