The Star Bar has been non-suited from litigation brought by Kathryn Gober, who fell flat on her face while exiting the dance floor at the Crockett Street nightspot.
As previously reported, Gober filed her suit against Nimtz & Pena Business Ventures, doing business as Star Bar, on Jan. 28 in Jefferson Count District Court, claiming she tripped because of poor lighting.
On March 3 Gober filed a motion for non-suit, stating that she "no longer wishes to prosecute her claims against Nimitz & Pena," court papers say.
Judge Bob Wortham, 58th District Court, granted the motion March 14, dismissing the defendant with prejudice.
Court records show that on March 21, 2009, Gober was exiting the dance floor "when she tripped and fell over an unlighted, darkly painted, unmarked raised bandstand adjacent to the dance floor in what would be assumed to be a normal walkway."
In her suit, Gober says she landed on her face, knocking out several teeth and causing damage to her neck and mouth. She also claims to suffer from blurred vision.
Gober alleges Star Bar negligently promoted use of the dance floor without ensuring all potentially dangerous hazards were eliminated.
