Suit alleges defect caused Honda ATV rollover

Honda Rancher 420 TM ATV

The owner of a Honda all-terrain vehicle has filed suit against Beaumont retailer Cowboy Honda and manufacturer Honda North America, alleging the ATV is defective.

Dewayne Diggles and his wife, Sherry, filed the suit Sept. 8 in Jefferson County District Court.

According to the lawsuit, on Jan. 1, 2010, Diggles was injured when a 2007 Honda Rancher 420TM ATV flipped over and landed on him.

The suit does not provide details of the incident.

The suit does, however, allege the ATV was defective and should not have been manufactured and sold by the defendants.

Diggles is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

His wife is suing for loss of consortium and household services.

Attorney Richard Denney of the Oklahoma law firm Denney & Barrett represents them.

Judge Gary Sanderson, 6oth District Court, has been assigned to the case.
