A man has filed suit against the driver who he claims slammed into his vehicle as he was attempting to change a flat tire on the side of the road.
Casey Williams claims he was changing a tire on the shoulder of U.S. 69 on Sept. 24, 2009, when defendant Jimmy Valsin, who was driving a vehicle for defendants LH Chaney Materials and Transit Mix Concrete, veered off the road and drove into his vehicle.
Because of the incident, Williams incurred medical costs, lost his earnings and his earning capacity and experienced physical impairment, physical pain and mental anguish, according to the complaint filed Sept. 8 in Jefferson County District Court.
Valsin negligently failed to keep a proper lookout, failed to timely apply his brakes and failed to drive within a single lane, the suit states.
In his complaint, Williams is seeking an unspecified judgment, plus interest, costs and other relief the court deems just.
Jonathan C. Juhan and J.J. Bragg of Beaumont will be representing him.
The case has been assigned to Judge Bob Wortham, 58th District Court.
