A locomotive engineer has filed suit against his employer, Union Pacific Railroad, alleging an "unexpected jolt" injured his back.
Under the Federal Employers' Liability Act, Michael Sebald filed suit against UPR on Sept. 19 in Jefferson County District Court.
According to the lawsuit, on June 18, 2010, Sebald was shoving railcars at UPR's Beaumont rail yard when "a hard, unexpected jolt and impact" injured his cervical spine and bilateral upper extremities.
Sebald alleges UPR had a duty to provide him with a safe place to work and negligently failed to provide him with the proper safety equipment.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
He is represented by the Law Offices of Gilbert T. Adams in Beaumont.
Judge Donald Floyd, 172nd District Court, has been assigned to the case.
