Man sues insurer for denying under-insured motorist claim

A Jefferson County man claims his insurance company refuses to reimburse him for damages he incurred during an automobile collision.

Mark Richard filed a lawsuit Aug. 29 in Jefferson County District Court against Metropolitan Lloyds Insurance Company of Texas.

In his complaint, Richard alleges he was involved in a collision caused by an under-insured motorist, Randy Maffett, on Nov. 21, 2009.

At the time, Richard had an insurance policy through Metropolitan Lloyd's, which should have provided coverage for a collision with an under-insured driver, according to the complaint.

However, Metropolitan Lloyds refused to pay for the medical expenses, physical impairment, lost earning capacity, pain and mental anguish Richard incurred during the collision, the suit states.

In his complaint, Richard seeks actual damages, attorneys' fees, declaratory relief, pre- and post-judgment interest, costs and other relief the court deems just.

C. Brooks Schuelke of Perlmutter and Schuelke in Austin will be representing him.

Judge Gary Sanderson, 60th District Court, has been assigned to the case.
