Nederland wreck subject of suit

A Nederland woman claims she sustained severe neck, back, left shoulder and left arm injuries after a driver failed to yield the right-of-way and slammed into her vehicle.

Twalla Faulk filed a lawsuit Oct. 7 in Jefferson County District Court against Joyce Cuniff.

In her complaint, Faulk alleges she drove at the intersection of Nederland Avenue and 14th Street in Nederland on Nov. 27, 2009, when Cuniff failed to yield the right-of-way and struck her vehicle.

In addition to her injuries, Faulk incurred medical costs, lost her earnings and her earning capacity and experienced physical impairment, physical pain and mental anguish, according to the complaint.

Faulk blames Cuniff for causing the collision, saying she negligently failed to keep a proper lookout, failed to timely apply her brakes and failed to turn only when it was safe to do so.

In her complaint, Faulk seeks an unspecified judgment, plus interest, costs and other relief the court deems just.

Jonathan C. Juhan and J.J. Bragg of Beaumont will be representing her.

Judge Gary Sanderson, 58th District Court, has been assigned to the case.
