A civil case against Market basket is heading toward trial in August 2012, according to a control plan order approved by a local judge on Tuesday.
As previously reported, Dana Falcon, a Market Basket employee who was injured when an oven exploded, filed suit against TSTL Investments, doing business as Market Basket No. 2, on June 21 in Jefferson County District Court.
According to the lawsuit, on June 5, 2011, Falcon was injured while working for the store when a commercial oven exploded.
Judge Bob Wortham, 58th District Court, signed off on the discovery control plan order on Jan. 10, 2012, court records show, calling for the case to be mediated before July 31 or face an August trial.
Falcon's original petition sought an injunction to stop the store from destroying possible evidence and to allow photographers to inspect the incident scene.
She is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
