Three Beaumont residents have filed suit against the driver who they claim rear-ended their vehicle.
Bessie Brown, Betty LeBlanc and Philoman Davis claim they were riding in a vehicle that had stopped for a traffic signal on Sept. 28, 2010, when defendant Donia L. McMahan struck their vehicle.
Because of the collision, the plaintiffs incurred medical costs, experienced physical pain and suffering and sustained physical impairment, according to the complaint filed Dec. 27 in Jefferson County District Court. In addition, they experienced mental anguish, lost their earning capacity and suffered disfigurement, the suit states.
McMahan negligently failed to control her speed, drove too fast, failed to keep a proper lookout, failed to keep a safe distance between her vehicle and the plaintiffs', failed to swerve to avoid a collision and failed to timely apply her brakes, the complaint says.
In their complaint, the plaintiffs are seeking actual damages, plus pre- and post-judgment interest at the highest legal interest rate, costs and other relief the court deems just.
