Man claims crash caused chest, back injuries

A Jefferson County man claims he sustained chest, neck and back injuries after a truck driver collided with his vehicle.

Kalen Guillory filed a lawsuit in Jefferson County District Court against Rafael A. Berdugo Garcia and C&O Cargo Corp.

In his complaint, Guillory claims he drove west on Cardinal Drive in Beaumont on Jan. 2, 2010, when Garcia, who was driving a truck for C&O Cargo Corp., made an improper lane change while attempting to turn left and struck his vehicle.

In addition to his injuries, Guillory incurred medical costs; experienced mental anguish, physical pain, suffering and disability; and lost his enjoyment of life, according to the complaint. He also lost his earning capacity and experienced physical impairment, the suit states.

Guillory blames Garcia for causing the collision, saying he negligently made an unsafe lane change and failed to keep a proper lookout.

In his complaint, Guillory seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

Clay Dugas and Mike Jacobellis of Beaumont will be representing him.

Judge Bob Wortham, 58th District Court, has been assigned to the case.
