29 companies sued in man's second asbestos suit

A second asbestos suit has been filed on the behalf of James Bennett, who has already sued once and received a settlement for his non-malignant asbestos-related disease.

James and Lucille Bennett filed the suit March 21 in Jefferson County District Court.

The defendants named in the suit are A.W. Chesterton, Bechtel Corp., CBS Corp., Certainteed Corp., Citgo Petroleum, Crane Co., Crown Cork & Seal, D&F Distributing, Dana Companies, ExxonMobil, Flour Enterprises, Flour Maintenance, Foster Wheeler Constructors, Foster Wheeler Corp., Foster Wheeler Energy, General Electric, Gould Pumps, Henry Vogt Machine, Ingersoll Rand, Metropolitan Life Insurance, Mobil Oil, Occidental Chemical, Owens-Illinois, Oxy USA, Riley Power, Sepco, Union Carbide and Uniroyal Holdings.

According to the lawsuit, Bennett worked as a carpenter and millwright and was exposed to asbestos products and asbestos fibers and dust, which caused him to suffer from a non-malignant, asbestos-related disease. No dates of employment are given.

The suit states this is Bennett's second asbestos suit for which he sues for a different malignant asbestos-related disease pursuant to Putejovsky v. Rapid American.

He has already settled his first claim with one or more of the defendants, according to the suit.

The defendants are accused of manufacturing, distributing and using asbestos products without warning workers of the dangers.

Bennett alleges the defendants acted with malice, entitling him to exemplary damages.

His wife is also seeking loss of consortium damages.

Beaumont attorney Bryan Blevins Jr. of Provost Umphrey represents them.

Judge Bob Wortham, 58th District Court, is assigned to the case.
