A woman has filed suit against the driver who she claims rear-ended her vehicle while she was stopped at a red light.
Janice Damond claims she was sitting at a red light in her stopped 1998 Mustang on May 6, 2011, when defendant Ann Clary Old, who was driving behind her, failed to brake and struck the back of her vehicle.
Because of the collision, Damond incurred medical costs, experienced physical pain and suffering and endured physical impairment, according to the complaint filed Sept. 27 in Jefferson County District Court. She also lost household services and suffered disfigurement and mental anguish, the suit states.
Damond blames Old for causing the collision, saying she negligently failed to keep a proper lookout, failed to apply her brakes and failed to stop at a traffic control device.
In her complaint, Damond is seeking damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.
She will be represented by Christopher D. Bertini of Bertini Law Firm in Galveston.
The case has been assigned to Judge Gary Sanderson, 60th District Court.
