Company claims $2M in repair costs associated with Ford fleet vehicles

A Beaumont business claims it has incurred numerous unnecessary repair costs costing more than $2 million to correct defects on some of the 123 Ford vehicles it purchased from a Winnie Ford dealership. 

T and D Solutions filed a lawsuit Oct. 24 in Jefferson County District Court against Ford Motor Co. and David Self Ford.

In its complaint, T and D alleges it has purchased about 123 Ford F-250 and Ford F-350 trucks from David Self Ford for a total purchase price of $4,676,065. According to the complaint, repair costs have forced the business to dole out an additional $2,148,177.63.

“Since purchase, the vehicles have encountered an excessive number of defects necessitating numerous repair visits and excessive down time for each vehicle,” the suit states.

Not only is T and D complaining about the number of repairs it has been forced to endure, but also about the denial of the warranty coverage on its vehicles.

T and D claims one of its warranties was wrongfully denied on Nov. 16, 2011, when an F-350 was brought to a dealership in Louisiana for repairs while another was denied for fuel contamination on July 24. The repairs cost the company $15,406, the complaint says.

Because of the numerous repairs, T and D Solutions claims it suffered a diminished value of the vehicles, lost their use, incurred repair costs, lost income and profits and incurred out-of-pocket costs.

It seeks actual, statutory and exemplary damages, plus attorney’s fees, costs, pre- and post-judgment interest at the highest legal rates and other relief the court deems just.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
