A man has filed suit against the driver who he claims failed to yield the right-of-way at a stop sign.
Harold Douglas Bean claims he was driving at the intersection of Highway 124 and Frint Drive in Beaumont on Feb. 7, 2011, when Eric Charles, who was driving a vehicle for defendant Ella Trucking Co., struck his vehicle.
Because of the collision, Bean suffered physical pain and mental anguish, lost earnings, suffered damages to his earning capacity and endured disfigurement, according to the complaint filed Feb. 6 in Jefferson County District Court. He also suffered physical impairment and incurred medical costs and property expenses, the suit states.
Charles negligently failed to yield the right-of-way at a stop sign, failed to timely apply his brakes, failed to keep a proper lookout, failed to turn to avoid a collision and failed to keep a safe speed, the complaint says.
In his complaint, Bean is seeking an unspecified judgment, plus pre- and post-judgment interest, costs, attorney’s fees and other relief the court deems just.
Bean, of Lumberton, will be appearing pro se.
The case has been assigned to Judge Bob Wortham, 58th District Court.
