A man has filed suit against the driver who he claims rear-ended his vehicle.
Charles Vernier claims he was driving on Twin City Highway at its intersection with Hogaboom Road in Port Arthur on Aug. 30, 2011, when defendant Justin Champagne, who was driving in the same direction, rear-ended his vehicle.
Because of the collision, Vernier incurred medical costs; experienced physical pain, suffering and impairment; and lost earnings, according to the complaint filed Feb. 7 in Jefferson County Circuit Court. Vernier also suffered disfigurement and mental anguish, the suit states.
Champagne negligently failed to keep a proper lookout, failed to turn to avoid a collision, failed to keep a safe distance between his vehicle and Vernier’s and failed to timely apply his brakes, the complaint says.
In his complaint, Vernier is seeking a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate, post-judgment interest at the legal rate, costs and other relief the court deems just.
Brett S. Thomas of Roebuck & Thomas in Beaumont will be representing him.
Judge Donald Floyd, 172nd District Court, has been assigned to the case.
