GALVESTON - H&E Equipment Services Inc. claims Texas International Terminals Ltd. owes it about $90,000 for repairs, recent court documents say.
A lawsuit filed Feb. 21 in Galveston County District Court states that Texas International's apparent refusal to honor the debt in the amount of $90,718.35 violates an agreement between the two companies.
In January 2012, the parties executed said agreement which enabled Texas International to rent equipment and obtain repairs from H&E on credit with payment.
The suit explains that Texas International sought out repairs for its Manitowoc Crane, which the plaintiff performed between September and October of last year in accordance to the contract.
An invoice with the amount in dispute was issued Oct. 22, 2012.
According to the suit, the defendant "failed and refused to pay, and continues to fail and refuses to pay" as of earlier this month.
"Texas International knew, or should have known, that the repairs were provided in anticipation of compensation, and were not furnish gratuitously," the original petition says.
Attorney Randall K. Lindley with Bell Nunnally & Martin LLP in Dallas is representing the complainant, and Galveston County 405th District Court Judge Michelle Slaughter is presiding over the case.
