A Port Arthur man claims he sustained neck and back pain after a driver rear-ended him.
Martin Espinoza filed a lawsuit June 21 in Jefferson County District Court against Gregory Vasquez.
In his complaint, Espinoza alleges he was stopped at the corner of 32nd Street and Woodrow Avenue and was waiting on a signal light when Vasquez failed to control his speed and to timely apply his brakes, slamming into the back of Espinoza’s vehicle.
In addition to his pain, Espinoza incurred medical costs and experienced physical pain, suffering and mental anguish, according to the complaint.
Espinoza blames Vasquez for causing the collision, saying he negligently failed to keep a proper lookout, failed to timely apply his brakes, failed to avoid the incident, failed to control his speed and failed to drive as a reasonable person would have.
In his complaint, Espinoza seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest at the highest legal rate, actual damages and other relief the court deems just.
Ryan Douglas White of Loncar and Associates in Beaumont will be representing him.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
