Hardin County resident Brian Benson has filed a wrongful termination lawsuit against Total Safety U.S.
The suit was filed Sept. 19 in Jefferson County District Court.
According to the lawsuit, on Aug. 19 Benson was in the course and scope of his employment with Total Safety when he was injured. He then submitted notice of a worker’s compensation claim.
On Aug. 26 Total wrongfully terminated Benson for seeking worker’s compensation, the suit states.
He had been with the company for eight years prior to the termination.
In his suit, Benson alleges the defendant acted with malice, entitling him to exemplary damages.
He is also suing for his past and future mental anguish, pain and lost earnings, plus court costs.
He is represented by Beaumont attorney Michael McGown of Benckenstein, Norvell & Nathan.
Judge Donald Floyd, 172nd District Court, is assigned to the case.
