SHERMAN - A Tennessee woman has filed a lawsuit against a Plano company claiming it violated the Telephone Consumer Protection Act by continuously calling her cell telephone in an attempt to collect an auto loan.
Lauren Cook filed suit against Capital One Auto Finance Inc. on Nov. 22 in the Eastern District of Texas, Sherman Division.
Cook claims that the defendant contacted her by placing as many as 10 calls a day to both her and her husband’s cell phones concerning an auto loan. The defendant placed calls using an automated telephone dialing system with an artificial or prerecorded voice, according to the suit.
During conversations with the defendant, Cook claims she requested that the defendant cease all automated calls to her phone and her husband’s. However, despite the requests the defendant continued to place calls to Cook’s cellular phone, the lawsuit alleges.
The defendant is accused of violating the Telephone Consumer Protection Act.
The plaintiff is seeking an award of damages, statutory damages, and treble damages.

A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
