Woman falls off treadmill, sues Curves

A woman who claims she was not warned of the dangerous condition of using a treadmill has sued the gym where she works out after falling off one and hitting a wall.

On Dec. 11, Wendeline Dugas filed suit against Jarrco Inc., doing business as Curves Nederland, in Jefferson County District Court. 

According to the lawsuit, on July 12, 2012, Dugas was using a treadmill at Curves when she “was caused to fall.”

The suit does not state how Dugas was caused to fall.

The suit only says that “due to the positioning of the treadmill, there was insufficient room between the machine and wall, resulting in severe injuries.”

Dugas accuses Curves of negligently failing to warn her of the dangerous condition and failing to inspect and maintain its premises.

The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain and impairment.

Attorney B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont represents the plaintiff.

Judge Bob Wortham, 58th District Court, is assigned to the case.
