Construction company sues plaza over agreement

A construction company is suing a shopping plaza developer claiming it hasn’t received any compensation besides the actual cost of work.


Wallace Construction & Development Co. filed a lawsuit Feb. 24 in the Jefferson County District Court against Madison Plaza LP, citing simple fraud, fraudulent inducement and breach of contract.

The lawsuit states Wallace Construction agreed to do work on the plaza for the actual cost of the work, plus 25 percent ownership in the plaza. The company was paid the actual costs, but hasn’t received any other profits from the plaza, the complaint states.

Wallace Construction is seeking for the court to enforce the joint agreement and damages between $200,000 and $1 million.

It is being represented by Christy Amuny of Bain and Barkley.
