Business sues landlord in rent dispute

A business is suing its commercial landlord in a rent dispute.


Bayou City Retail Group LLC filed a lawsuit Feb. 28 in the Galveston County District Court against Jule Lauve Jr. Inc. in an attempt to get a restraining order preventing the business from being locked out of its space. 

The lawsuit states Bayou City Retail began renting retail space in February 2009. An employee delivered a rent check to Lauve’s mail slot on Feb. 11, 2014, but Lauve claims never to have received it, according to the complaint.

Bayoe City Retail said letters from Lauve didn’t follow default statutes because it didn’t allow for the business to cure a default.

Bayou City Retail wants a court to prohibit the landlord from changing the locks or restricting access, set an injunction hearing and issue an injunction against Lauve. It is also seeking a declaratory judgment, pre and post-judgment interest at the highest rate allowed by law and court costs.
