A medical company is suing a similar company for false association and trademark infringement.
Proteus Digital Health Inc. filed suit in the U.S. Court for the Eastern District of Texas, Sherman Division, on March 12, naming Proteus Biomedical LLC, Michael Clichy and David Clichy as defendants.
According to the suit, Proteus Digital makes ingestible medical sensors and its name has been trademarked since 2007. It claims Proteus Biomedical has infringed on its trademark which is damaging to its image and marketability.
Proteus Digital says customers recognize it's name but have become confused by Proteus Biomedical.
Preotus Digital claims they have contacted Proteus Biomedical and told them to stop infringing in its mark, but the Clichy's have not stopped the infringement, the suit alleges.
Preotus Digital wants a court order which would prohibit Preotus Biomedical from continuing to infringe on its mark and confuse consumers and is seeking an undisclosed amount in damages.
