Homeowner sues insurance company over damage

A homeowner is suing an insurance company, its insurance adjuster and a restoration company because of alleged problems arising in the repair of his home.

David Green filed a lawsuit March 21 in the Galveston County District Court against Allstate Texas Lloyds, S & R Operations Inc., doing business as ServPro of Kingwood/Humble, and Allstate insurance adjuster Tom Packman, citing fraud, non-compliance with Texas Insurance Code-unfair settlement practices, conspiracy to commit fraud, breach of contract and violations of the Deceptive Trade Practices Act. 

The lawsuit states Green reported losses on his home in League City and requested repairs. Green alleges that Packman was not properly trained, failed to conduct a proper investigation, undervalued the damages and misrepresented what insurance would cover, the complaint said.

ServPro was to restore the area to original condition, but Green claims the area will need to be redone because ServPro didn’t remove all water-damaged materials like sheetrock and flooring.

Green is seeking damages in excess of $200,000 but less than $1 million.

He is being represented by Scott A. Shaver of Shaver Morgan PLLC.
