Truck owner sues over transmission repairs

A truck owner is suing an auto dealership after his transmission failed after it was supposed to be repaired.



Brad Berg filed a lawsuit March 31 in the Jefferson County District Court against Mingle Motor Co., doing business as Allen Samuels Chrysler Dodge Jeep Ram, citing violation of the Texas Deceptive Trade Practices Act and fraud.

The lawsuit states Berg took his 2006 Dodge Ram 2500 5.9 Liter Turbo Diesel truck to be serviced at Allen Samuels and was told it needed a new transmission and that all the main crank bearings and all six piston rods needed to be replaced. The work was done and Berg paid $7,295.94, the complaint states. Shortly after the repairs were made, Berg was driving the truck when it broke down and he saw the transmission housing and engine block was busted. The truck was towed and is in storage, the complaint said.

Berg is seeking damages between $100,000 and $200,000 which includes actual damages, exemplary damages, statutory damages, plus court costs and pre and post-judgment interest.

He is being represented by Justin G. Sanderson of the Sanderson Law Firm PLLC in Beaumont.
