Motorcyclist files lawsuit against driver who collided with him

A motorcyclist claims he sustained pain and mental anguish after a driver failed to yield the right-of-way and struck his vehicle, according to a recently filed lawsuit.


Bryan David Therrell filed a lawsuit July 14 in the Galveston County District Court against Marc J. Chiasson. 

In his complaint, Therrell claims he was driving his motorcycle in the 1300 block of West FM 646 in Galveston County on Nov. 11, when Chiasson struck his vehicle.


Because of the collision, Therrell suffered physical pain and mental anguish, incurred medical costs, experienced a diminished earning capacity and endured physical incapacity and disability, according to the complaint. He also suffered disfigurement and endured physical impairment, the suit states.


Therrell blames Chiasson for causing the collision, saying he negligently failed to keep a proper lookout, failed to swerve, failed to bring his vehicle to a stop, failed to timely apply his brakes, failed to equip the vehicle with adequate breaks, failed to give a signal of his intention and failed to yield the right-of-way.


Therrell seeks actual damages, plus pre-judgment interest, costs and other relief the court deems just.


He is being represented by attorneys Daniel P. Barton and Ryan K. Haun of Barton Law Firm in Houston.
