Port Neches woman asks for testimony in anticipated wrongful death claim

A Port Neches woman is asking to depose a man in anticipation of a wrongful death lawsuit she expects to file after he passes away. 

Sharon LaRue filed a petition to perpetuate the testimony of Aaron McBride. The petition was filed Aug. 25 in Jefferson County District Court. 

According to the petition, LaRue anticipates filing a wrongful death and gross negligence lawsuit in Jefferson County against McBride's former employer, Total Petrochemicals & Refining USA Inc. along with Atlantic Richfield Co. and BP Products North America Inc. 

LaRue alleges McBride has been diagnosed with lung cancer. The disease "is expected to progress, ultimately proving fatal," the petition reads. LaRue says she needs to take McBride's deposition now to use as evidence in the anticipated lawsuit.

LaRue asks the court to authorize the videotaped recording and written record of McBride's deposition in order to perpetuate his testimony.

Attorney J. Keith Hyde, of Provost Umphrey Law Firm in Beaumont, represents LaRue.
